Why Highway 401 Tickets Deserve Extra Attention
Highway 401 runs the length of the Greater Toronto Area and beyond, carrying more traffic than almost any road in North America. The OPP actively patrols it with dedicated highway safety units, and automated enforcement continues to expand. A ticket on the 401 is often more serious than the same ticket on a city street — here's why.
Speed Zones on the 401
Most of the 401 through the GTA is posted at 100 km/h. Some stretches outside the city increase to 110 km/h. This matters because Ontario's stunt driving law (Section 172 HTA) is triggered at 40+ km/h over the posted limit. On a 100 km/h highway, travelling at 141 km/h triggers an immediate 24-hour roadside licence suspension and vehicle impoundment — a stunt driving charge.
Penalty Tiers for Highway Speeding
- 1–15 km/h over: $2.50/km fine, 0 demerit points
- 16–29 km/h over: $3.75/km fine, 3 demerit points
- 30–49 km/h over: $6.00/km fine, 4 demerit points
- 50+ km/h over: $9.75/km fine, 6 demerit points, court-required, licence suspension risk
- 40+ km/h over (stunt driving): Immediate roadside suspension, vehicle tow/impound, court appearance, $2,000–$10,000 fine, licence suspension up to 2 years
OPP Enforcement Tactics
OPP highway units use laser speed measurement (LIDAR), unmarked vehicles, and aircraft-assisted speed enforcement on certain 401 corridors. They're experienced witnesses in provincial offences court and come to trial prepared. This is not the place to try to represent yourself if the charge is serious.
Common 401 Ticket Defence Strategies
Despite the enforcement expertise, Highway 401 tickets are regularly defended successfully. Key angles include:
- Laser calibration records: LIDAR equipment must be calibrated before and after use. Missing or incomplete records undermine the reliability of the speed reading.
- Target identification: On a congested multi-lane highway, positively identifying which vehicle was clocked can be difficult. Challenging target lock is a legitimate defence.
- Speed dispute: Speedometer evidence, combined with cross-examination of the officer's notes, can create reasonable doubt about the alleged speed — potentially dropping a charge from one penalty tier to a lower one.
- Crown negotiation: Prosecutors regularly agree to reduced charges to avoid trial. Dropping from 4 demerit points to 0 demerit points has enormous insurance consequences.
