Section 172 of the HTA covers a wide range of dangerous driving behaviours, and the penalties have become increasingly severe over the years. 2025 Update: Speed Threshold Change
Effective in 2025, Ontario adjusted the stunt driving speed thresholds. The "40 km/h over" trigger applies in zones with speed limits of 60 km/h or higher. In lower-speed zones (school zones, community safety zones), the threshold can be even lower. OPP and municipal police are briefed on these updated standards.
Immediate Roadside Penalties — Before Any Trial
What makes stunt driving charges uniquely devastating is that severe penalties apply immediately at the roadside, before you've had any opportunity to appear in court:
- Immediate 30-day licence suspension: Your licence is suspended on the spot by the officer
- Immediate 14-day vehicle impoundment: Your vehicle is towed and held for 14 days regardless of outcome
- Impound fees: Typically $200-400 per day in storage fees, plus towing costs of $200-500
These roadside penalties apply even if you are ultimately found not guilty. Getting them back requires a separate legal process.
Court Penalties Upon Conviction
If convicted of stunt driving, the penalties are among the most severe under the HTA:
- First conviction: Fine of $2,000 to $10,000, licence suspension of 1-3 years, 6 demerit points, possible jail term of up to 6 months
- Second conviction (within 10 years): Fine of $2,000 to $10,000, mandatory licence suspension of 3-10 years, possible jail term
- Subsequent convictions: Escalating penalties including potential permanent licence revocation

A stunt driving conviction almost always results in your insurance company cancelling your policy. You'll be classified as a high-risk driver and forced into the Facility Association (Ontario's insurer of last resort), where premiums can be $8,000-$20,000 annually or higher.
